Health Guarantee and Contract

SELLER GUARANTEE

Seller guarantees that at the time of delivery the puppy is in excellent health. All Lonestar Bernedoodle puppies are vet checked several times. Should the puppy be found in poor health of a serious nature, Seller will provide Buyer with a replacement puppy from another litter or a full refund of the purchase price of the puppy only. Shipping fees will not be refunded.

 

The following conditions apply to the sale of the aforementioned puppy:

 

  1. The buyer has three (3) days from the time of receipt of the puppy to have the puppy examined by a veterinarian. Any request to return the puppy to Seller for a full refund must be made within this time period and may only be requested should the puppy prove to be sick upon arrival. Proof of examination must be provided.

  2. A warranty against all life threatening or seriously debilitating genetic disease is provided until the dog is one year of age. Should a genetic disease be discovered during this time that will greatly shorten the life of or greatly harm the quality of life of the dog, Seller will provide Buyer with a full refund of the purchase price only. We do NOT require you to return the dog.

  3. A warranty for Hip Dysplasia is provided for one year. This warranty will be terminated should the dog be allowed to become overweight or developing joints be overstressed at any point during the first year. Should dog be found to have moderate or severe Hip Dysplasia within the first year of life, Seller will provide a replacement puppy or refund of purchase price. Buyer must provide Seller with proof in the form of documentation from PennHIP or OFA. We reserve the right to confirm the results before a replacement or refund is provided.

  4. Lonestar Bernedoodles’ puppies are sold on a STRICT NON-BREEDING contract. Buyer agrees to spay or neuter this dog by 12 (twelve) months of age. Buyer must send proof to Seller via email or regular mail. Upon execution of this contract, Buyer agrees this dog is being sold as a PET and will never be used for breeding. Failure to follow through with the spay/neuter contract as outlined above will terminate your Health Warranty. Legal action may be started for the breach of the contract. Any legal fees incurred by the Seller to enforce this non-breeding contract are the sole responsibility of the Buyer. If Buyer uses the puppy to breed, Buyer will owe the seller $3500 for each puppy sold, and must also pay the breeding fee that applies to puppies sold without a spay/neuter contract. Any legal fees incurred by the Seller to enforce this are the sole responsibility of the Buyer. The case will be handled in a court in the Seller’s county.

  5. Under no circumstances shall the Seller be liable to the Buyer or to any third party for any consequential, incidental or special damages resulting from or in a manner related to the dog/puppy.

  6. Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the Buyer.

 

MAINTENANCE

Buyer agrees to maintain this puppy/dog in good health, provide routine preventative health care including, but not limited to, vaccinations, heart worm prevention, flea and tick control, regular baths, grooming, and any other preventative medication a vet feels is needed. Veterinary records must be provided to Seller if requesting refund or replacement. If any of the above preventative care has not been provided, the health warranty will be void.

 

REHOMING YOUR BERNEDOODLE

If at any point the Buyer can no longer care for the puppy purchased with this contract, Lonestar Bernedoodles requires the Buyer return the puppy to us. The puppy is not to be given or sold to another person under any circumstances for permanent care without first contacting Lonestar Bernedoodles. This condition does not expire and does apply to the puppy for the duration of his/her lifetime. Giving away or selling the puppy to another person will be considered a breach of contract and the Buyer may owe the breeder ____________, the total price paid for the puppy. Any legal fees incurred by the Seller to enforce this are the sole responsibility of the Buyer. The case will be handled in a court in the Seller’s county.
